How long does an executory commercial proceeding take?
It depends on the venue, the court\u2019s caseload and the motions filed by the opposing party. The executory route is the shortest when the underlying document is a negotiable instrument, which is why we start by reviewing the document.
Sue or negotiate?
When the amount in dispute is less than the cost of litigation, negotiating with an enforceable settlement is usually the better outcome. We say so even when it means not litigating.
Do you review contracts before a dispute exists?
Yes. It is the cheapest intervention of all and the least requested. We review framework agreements, promissory notes, guarantees and bylaws.
